Lotto is a game of chance based on a random selection of numbers. It is not possible to consistently predict a random event. To this end, Bytes of Eight accepts no responsibility or liability for losses incurred by the Customer or any other party arising in any way from or in connection with using the information contained within the Customer's purchase order.
Bytes of Eight does not warrant or represent that the information provided on the Customer's purchase order is free from any defects or errors. Bytes of Eight is not liable to the Customer or any other party for any loss or damage however caused resulting directly or indirectly from the Customer's use of the purchase order and the Customer's uses the information provided with the purchase order at the Customer's own risk.
Conditions of Sale and Ordering Information
General These conditions of sale are deemed to apply to the purchase order made by the Customer. The Customer agrees to be legally bound and to abide by the conditions of sale, just as if the Customer had signed this Agreement.
Purchase Orders A purchase order placed by the Customer is deemed to incorporate these conditions of sale.
A purchase order for the Perth metro area for any "Saturday draw" must be received by 5.00pm on the preceding Wednesday and a purchase order outside the Perth metro area must be received by 5.00pm on the preceding Tuesday.
A purchase order for the Perth metro area for any "Tuesday draw" must be received by 5.00pm on the preceding Friday and a purchase order outside the Perth metro area must be received by 5.00pm on the preceding Thursday.
Purchase orders outside the state of Western Australia will be taken at the absolute discretion of Bytes of Eight.
The Customer must ensure that the correct mailing address is given to Bytes of Eight at the time of the purchase order.
Prices
All prices are expressed in Australian Dollars (A$) inclusive of GST and are inclusive of standard postage charges.
Alternative forms of Postage The Customer will pay Bytes of Eight an additional sum equivalent to the cost of any alternative form of postage including but not limited to express post and registered post.
Payment The Customer can make payments by direct debit, cheque or money order (drawn payable to Bytes of Eight). No credit card transactions are possible at this time.
Cheque or money order payments can be sent to Bytes of Eight at PO Box 1057 Gwelup WA 6018. The Customer's order will be forwarded as soon as the Customer's payment is received and, in the case of Customer cheques, as soon as verification of the same is complete.
Refund Policy
If the Customer cancels the Customer's purchase order prior to Bytes of Eight posting the Customer's purchase order, then Customer can obtain a full refund less any amount paid for alternative forms of postage.
The Customer is not entitled to a refund if, at the time of communicating the Customer's cancellation, Bytes of Eight has already posted the Customer's purchase order.
Under no circumstances can the Customer resell the Customer's purchase order to a third party.
Things beyond Bytes of Eight's control
Bytes of Eight will not be liable to the Customer for any failure to fulfil any condition of this agreement where that fulfillment is delayed or prevented, restricted or interfered with for any reason beyond Bytes of Eight's control, including but not limited to fire, storm, flood, earthquake, accident, changes in law, strikes, war, acts of terrorism or delays in transportation.
Miscellaneous
The laws of Western Australia will govern any dispute arising from the conditions of sale of this agreement or a breach of this Agreement.
This Agreement constitutes the entire agreement between Bytes of Eight and the Customer with respect to the subject matter contained herein and supersedes all previous and contemporaneous agreements, proposals and communications, written or oral between Bytes of Eight and the Customer. Bytes of Eight may amend or modify this Agreement or impose new conditions at any time upon giving notice to the Customer. Upon receiving notice, the Customer shall be deemed to accept such amendments, modifications or new conditions.
Privacy Statement
Bytes of Eight respects the privacy of the Customer. All personal information provided to Bytes of Eight will remain confidential and will reside with the owners of Bytes of Eight.
This personal information will NOT be disclosed to any third party.
